For clients facing complex, high-value disputes, the cost of pursuing a claim can be prohibitive – regardless of how strong the underlying case may be. LFR helps clients explore alternatives to self-financing their litigation.
Connecting a client to a funder is the easy part. What actually determines the outcome of a communication with a potential funder is what happens long before it: how the case is presented.
From the funder's perspective, litigation funding is a form of venture investment, and as with any venture pitch, the quality of the presentation materially affects the terms of the offer. A well-packaged case, with its strengths clearly identified and its prospects candidly assessed, is priced more favorably. A case presented as a raw file, even with counsel's opinion on the merits attached, typically results in funders demanding a higher percentage of recovery in exchange for financing.
Preparing a pitch to the founder is where LFR's role is most valuable. We then present the case directly to funders. Our standing with the funders we regularly work with also matters here as well – when we manage a matter, funders extend a degree of trust to the case on that basis alone, relying on our ability to assemble the right team behind it. That trust is itself no small factor in how a case is received.
If you would like to explore whether litigation funding may be an option for your matter, we would be glad to discuss it with you in confidence.
